The round table will discuss the pressing issues arising from the interaction of business and the state. How proportionate and founded is the state’s so-called prosecutorial bias in controlling the business; how to strike the right balance between the state’s ambition to make economic leap and its willingness to “squeeze” the business dry; is business faultless in its natural strive for profit, given that it follows the rules set out for it; what is the relation between inherently rational legislation and its enforcement that is not nearly perfect?
In the context of this topic, special attention will be given to the tasks, opportunities and established practice of using criminal regulation tools in the matters of establishing and reaching the proper balance of interests of the state and business.
The round table will discuss the characteristic criminal risks of investors and managers engaged in production and commerce and its financing, as well as proportionality to environmental and fiscal requirements. The discussion will also address the relation of business with law enforcement and regulatory agencies against the backdrop of the existing problem of direct criminal prosecution of business process participants.
The participants of the round table will express and evaluate their views on how to amend and improve these relations.
