The session will address the following issues:
  • Deficiencies of the current Russian system of estate management: risks of losing assets, inability of business entities to make decisions.
  • The system of inheritance protection and its management in foreign jurisdictions. Finding of assets, their inclusion into the estate, satisfaction of claims of the deceased’s creditors. Family assets preservation: foreign approaches.
  • Request for a contract of inheritance: which families can benefit from this legal novelty, and when?
  • Joint will of spouses in a case of joint property. Elimination of the requirement to allocate the share of a surviving spouse. Guaranteeing the protection of rights and interests of a surviving spouse in case of a joint will.
  • “Inheritance” funds. The fund model proposed to the Russian legislator: security measures for creditors of the establisher of a fund, measures of execution of the establisher’s will after their death.
